Terms and Conditions of Sale (effective 01/01/2026)

1 - Preamble

These general terms and conditions of sale apply exclusively between the company Devmel SAS, whose registered office is located at 117 route des Sarrazins, 73500 Saint-André, France, company registration number RCS 802 860 171 (FR06802860171), and any person visiting or making a purchase through the website devmel.com, or directly from the company Devmel SAS.

Devmel SAS reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions in force on the date of the order shall apply to each order.

These general terms and conditions of sale are presented and submitted for validation during the order process, prior to its final confirmation. Any order placed by the Customer therefore confirms their definitive and irrevocable acceptance. They are applicable in all countries delivered to by Devmel SAS. Contractual information is provided in French.


2 - Products and Orders

Orders are placed exclusively online via our website devmel.com.

Devmel SAS presents on its website, for all available products, a detailed description allowing the potential buyer to know, before placing a final order, the essential characteristics of the products they wish to purchase. These descriptions are written based on technical information provided by the product manufacturers; therefore, the liability of Devmel SAS cannot be engaged in the event of inaccuracy or obsolescence of the information.

Photos and illustrations are provided for indicative purposes only and cannot under any circumstances engage the liability of Devmel SAS, nor call into question the validity of an order placed or a sale made.


3 - Prices

All prices are expressed and managed in Euros and take into account the French VAT applicable on the day of the transaction. Prices inclusive of VAT (TTC) do not include shipping costs. Shipping costs are subject to separate pricing based on the total weight of the order or any applicable waiver of charges.

Devmel SAS reserves the right to modify its prices at any time and without prior notice. The sale price retained for the purchase of a product is the price displayed online at the time the order is recorded on the website.

Products remain the property of Devmel SAS until full payment of the price has been received.


4 - Availability

Our product offers and prices are valid as long as they are visible on the website, within the limits of available stock.

Upon receipt of your order, we verify the availability of the ordered product(s).

In the event of unavailability, we undertake to inform you as soon as possible. If delivery does not occur within a maximum period of 30 days from the validation of the order, the customer may request the resolution of the contract under the conditions provided for in Articles L216-1 et seq. of the French Consumer Code and obtain a refund of the amounts paid.


5 - Payment

Payments are accepted by bank transfer or bank card (Carte Bleue, Visa, MasterCard).
Only consumer payment cards issued within the European Economic Area and subject to Regulation (EU) 2015/751 on the capping of interchange fees (maximum 0.3%) are accepted.
Consequently, corporate, cashback, and prepaid cards, as well as cards issued outside the European Economic Area, are not accepted.

Payment by bank card is processed on the secure banking servers of our partners. This means that no banking information concerning you passes through the Devmel SAS website. Your credit card details are encrypted using the SSL (Secure Socket Layer) protocol and never transit in plain text over the network. Payment is made directly to the bank.

Payment by bank card is therefore completely secure; your order will be recorded and validated upon acceptance of the payment by the bank.

Devmel SAS reserves the right to refuse to fulfil a delivery or honour an order from a customer who has not fully or partially paid for a previous order, or with whom a payment dispute is currently being handled.


6 - Delivery

Products purchased on devmel.com are delivered exclusively within the European Union.

Delivery is made to the delivery address specified by the customer when placing the order. It will be carried out by La Poste (tracked Colissimo service) or by another carrier. Delivery can only take place once the order has been validated by the customer and payment has been made in full. The relevant banking payment centres will have given their prior approval for payment. In the event of refusal by said centres, the order will be automatically cancelled.

Shipping costs are borne by the buyer (unless a promotion or special offer applies) and are displayed in the shopping cart.
If the ordered item is available in stock, the dispatch time is approximately 3 working days for any order. Time frames are given as an indication only.

In the event of a dispatch delay or stock shortage, the restocking time varies between 5 and 30 days depending on the product. Delivery times begin only from the date of payment of the order. We invite you to check your tracking number sent by Devmel SAS in the dispatch confirmation.

In cases of force majeure (within the meaning of Article 1218 of the French Civil Code) or exceptional events (natural disaster, epidemic, strikes, etc.) delaying or preventing the delivery of goods, the company Devmel SAS is released from all liability. In any case, timely delivery can only take place if the customer is up to date with their obligations towards Devmel SAS.

Furthermore, the company Devmel SAS reserves the right to refuse any order from a customer with whom a current or previous dispute exists.


7 - Right of Withdrawal

In accordance with the legal provisions in force, you have a period of 14 days from the date of delivery of the order to exercise your right of withdrawal and receive a full refund (including initial shipping costs), with the exception of the return shipping costs, which remain your responsibility and at your risk.

The right of withdrawal applies exclusively to consumers as defined by the French Consumer Code.
It may also apply to professionals when the conditions of Article L221-3 of the French Consumer Code are met.

Please return products complete (items, manuals, cables, remote controls, warranties, etc.). In accordance with Article L221-23 of the French Consumer Code, the consumer's liability may be engaged in the event of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the product.
Incomplete or heavily damaged products may result in a partial or total reduction in refund.

Refunds for products will be processed as soon as possible, and at the latest within 14 days following the date on which the right of withdrawal was exercised. However, in accordance with Article L221-24 of the French Consumer Code, this refund period is deferred until the goods have been actually recovered, or until proof of their dispatch has been provided.

Refunds will be made using the payment method used at the time of your purchase.


8 - Return Procedure

The customer informs the company Devmel SAS of their decision by any written means that allows proof to be retained (the date of the request is taken as reference in the event of withdrawal within a period of 14 days).
If necessary, a return number will be communicated to you in order to track your request and facilitate its processing.

The support team will respond to you as soon as possible to explain the procedure to follow according to your request.

For any product return, if necessary please indicate the return number that Devmel SAS will have communicated to you in advance.

The return of goods is carried out at the customer's expense, risk, and peril.


9 - Warranty

The consumer benefits from the legal guarantee of conformity provided for in Articles L217-3 to L217-20 of the French Consumer Code.
The consumer also benefits from the legal guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.
No commercial warranty is granted by the company Devmel SAS beyond the aforementioned legal guarantees.

Legal guarantees do not apply to defects resulting in particular from:
- misuse or negligence.
- a repair attempt carried out by a service provider other than Devmel SAS;
- improper use, incorrect operation or maintenance, including but not limited to use of the product for purposes other than its normal intended use.
- installation or use of the product not in compliance with technical or safety standards in force in France;
- connection to an electrical supply of incorrect voltage;
- accidents, damage resulting from lightning, spilled liquid or flooding, inadequate ventilation, voltage surges, fire, or any other case of force majeure;

Under the legal guarantee of conformity, the consumer:

  • has a period of two years from the delivery of the goods to take action;
  • may choose between repair or replacement of the goods, subject to the conditions provided for by law;
  • is exempt from providing proof of the existence of the conformity defect during the twenty-four months following the delivery of the goods.

The return of goods is carried out at the customer's expense, risk, and peril.


10 - Data Protection

All information transmitted to the company Devmel SAS will remain strictly confidential and will never be sold or disclosed to third parties (unless the customer agrees), other than those directly involved in the execution of the order.

Personal data is retained for the period strictly necessary for the management of the commercial relationship and applicable legal obligations.

In accordance with Regulation (EU) 2016/679 (GDPR), the customer has the rights of access, rectification, erasure, limitation, opposition, and portability of their data.

11 - Ownership

The company Devmel SAS, as seller, retains full ownership of the goods sold until full payment of the principal and accessory price has been effectively received.


12 - Jurisdiction

These general terms and conditions of sale are governed by French law. In the event of a dispute, the customer and the seller have the option, before any legal action, to seek an amicable resolution.

In the absence of an amicable resolution, the territorially competent French courts shall have jurisdiction in accordance with the provisions of the French Consumer Code.


13 - Annex: Withdrawal Form
